Sales Policy for Apex Vending Canada

This Sales Policy outlines the terms and conditions governing all purchases made through Apex Vending Canada (“Apex Vending Canada,” “we,” “our,” or “us”). By placing an order with Apex Vending Canada, the customer (“buyer,” “customer,” or “you”) agrees to the following terms.

1. Product Availability

All products listed on our website are subject to availability and inventory levels. Product availability, lead times, and pricing may change without notice.

Estimated delivery timelines are approximate and may vary due to:

  • Manufacturer delays
  • Shipping carrier delays
  • Customs clearance
  • Seasonal demand
  • Supply chain disruptions

Apex Vending Canada is not liable for delays outside of our control.

2. Pricing

All prices are listed in Canadian Dollars (CAD) unless otherwise stated.

Prices do not include:

  • Applicable taxes
  • Shipping or freight charges
  • Liftgate/tailgate service
  • Installation
  • Card reader activation fees
  • Additional accessories or upgrades

Pricing may change at any time without notice prior to order confirmation.

3. Deposits and Payments

A 20% non-refundable deposit is required to secure inventory, reserve equipment, and begin order processing, including payment system setup and machine preparation.

Orders are not confirmed until the required deposit has been received.

The remaining balance must be paid in full prior to shipment, delivery, or pickup unless otherwise agreed to in writing.

Unless otherwise stated:

  • Deposits are non-refundable once order processing has begun
  • Full payment must be completed before shipment or pickup
  • Orders may be delayed if payment is not received on time

We reserve the right to cancel orders for unpaid balances.

Accepted payment methods may include:

  • E-Transfer
  • Wire Transfer
  • Debit/Credit Card
  • Financing through third-party providers

Additional payment processing fees may apply for credit card transactions.

4. Shipping and Delivery

Apex Vending Canada offers shipping across Canada through third-party freight carriers.

Customer Responsibilities

The customer is responsible for:

  • Providing accurate delivery information
  • Ensuring the location is accessible for delivery
  • Confirming doorway, hallway, elevator, and site dimensions
  • Ensuring adequate manpower or moving equipment is available if required

Additional delivery charges may apply for:

  • Residential deliveries
  • Remote locations
  • Re-delivery attempts
  • Missed appointments
  • Stairs or difficult access

Risk of loss transfers to the customer upon delivery.

5. Inspection Upon Delivery

Customers must inspect all products immediately upon delivery.

Any shipping damage, shortages, or issues must be:

  • Noted on the delivery receipt
  • Reported to Apex Vending Canada within 24 hours of delivery

Failure to report shipping damage within the required timeframe may void freight claims.

6. Returns and Exchanges

All Sales Final

Unless otherwise approved in writing, all sales are final.

Due to the nature of vending equipment, custom configurations, and commercial products:

  • Returns are generally not accepted
  • Deposits are non-refundable
  • Shipping costs are non-refundable

Approved Returns

If a return is approved:

  • The customer may be subject to a restocking fee
  • The customer is responsible for return shipping costs
  • Returned items must be unused and in original condition

Custom orders, special-order products, software licenses, payment systems, and installed equipment are non-returnable.

7. Warranty

Warranty coverage varies depending on the product.

New Equipment

Most new vending machines include:

  • 1-Year Manufacturer’s Warranty

Refurbished Equipment

Refurbished equipment may include:

  • Limited parts warranty (commonly 30–90 days)

Warranty does not cover:

  • Improper installation
  • Customer misuse
  • Vandalism
  • Cosmetic damage
  • Power surges
  • Water damage
  • Unauthorized modifications
  • Normal wear and tear

Extended warranty options may be available for select products.

8. Technical Support

Apex Vending Canada provides technical support assistance for supported products during regular business hours.

Support may include:

  • Phone support
  • Video troubleshooting
  • Basic operational guidance

On-site service visits, repairs, replacement parts, and travel charges may incur additional fees unless covered under warranty.

9. Payment Systems and Processing Fees

Card readers and payment systems may require:

  • Monthly service fees
  • SIM/data fees
  • Processing fees charged by third-party payment providers

Customers are responsible for maintaining active merchant accounts and complying with payment processor requirements.

Processing fees are non-refundable.

10. Product Specifications

Product images, dimensions, capacities, and specifications listed on the website are provided for informational purposes only and may vary by manufacturer updates or machine configuration.

Apex Vending Canada reserves the right to modify specifications without notice.

11. Limitation of Liability

Apex Vending Canada shall not be liable for:

  • Lost profits
  • Business interruption
  • Lost sales
  • Indirect or consequential damages
  • Product misuse
  • Delays caused by third parties

Maximum liability shall not exceed the amount paid for the purchased product.

12. Financing

Financing approvals are subject to third-party lender requirements and credit approval.

Apex Vending Canada does not guarantee financing approval or financing terms.

13. Governing Law

This Sales Policy shall be governed by and interpreted in accordance with the laws of the Province of Ontario and the laws of Canada applicable therein.
